Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Dunbar Mountain; Employees exposed to being struck by falling trees in that employees felling trees were not provided initial training and periodic training on the hazards associated with their job. Among others, one feasible and useful means of abatement would be to establish a training program for the woods crew that would include the following elements: 1. Training program on the proper method of felling trees. 2. Designation of a competent person. 3. Management commitment to the training program. 4. Enforcement procedures by management. 5. Employee training program is ongoing and effective.
