OSHA Act of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to caught-between /crushed-bystruck-by hazards. a) Worksite 471 Rt. 25A, Miller Place, NY- An employee operating a Yale Forklift was not wearing his seatbelt. The forklift tipped over and the employee was ejected. The employee was caught between the Roll Over Protection System and the ground; on or about 6/9/16. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
