29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: JOBSITE: The employer did not ensure that the employees, engaged in the following tasks were not only provided with, but also wearing appropriate personal protective equipment (PPE): 1. Appropriate personal fall arrest systems and/or other equivalent safe means for the two (2) employees lowering and/or cutting tree branches from the 3 in 12 pitch roof at a height 10 feet 9 inches from the ground. On or about 06/04/2016, one of the two (2) employees fell to the ground from the roof while performing the above task and sustained fatal injuries from the incident. 2. A cut-resistant leg protection device for the employee operating a Stihl chainsaw on the ground to cut tree branches.
