THE CITATION ISSUED JANUARY 25, 1999 IS HEREBY AMENDED TO READ: Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Employees climbing in the derrick while constructing equipment support racks are exposed to the hazard of falling approximately 30 feet, without the employer providing fall protection equipment or fall arrest system. One feasible and acceptable abatement method includes but is not limited to providing personal protective equipment to arrest a fall within six feet or provide personal protective equipment used as positioning equipment to protect the employees from the fall hazard. API Recommended Practice 54(RP 54) 4.5.1 requires "Every employee, when engaged in work ten feet or more above the rig floor or other working surfaces shall wear a safety belt with attached lanyard". Additionally, 29 CFR 1926.502(a)(2) requires "Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before the employee begins the work that necessitates the fall protection". As a means of abatement the employer shall have OHSB Consultation inspect the fall protection system to assure that it is adequate and do an onsite fall protection training for employees. Consultative services shall also include an onsite noise assessment. These Consultative services will be completed within 3 months or the citations will not be deemed abated.
