29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at 2020 Washington Blvd., Easton, PA on May 25, 2016, when employees engaged in roofing work were working at the unprotected edges of a residential roof, approximately 8 to 25 feet above a lower level on an 8 in 12 pitch, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard.
