29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Cement Products Inc. Located at 389 Park Avenue East Mansfield, Ohio; On or about May 6, 2016, the employer failed to develop and implement the elements of a hearing conservation program. An employee working in the manufacturing building was exposed to occupational noise at an eight-hour time weighted average of 91.6 dBa, which exceeded the OSHA action limit of 85 dBa. b) Cement Products Inc. Located at 389 Park Avenue East Mansfield, Ohio; On or about May 6, 2016, the employer failed to develop and implement the elements of a hearing conservation program. An employee working in the manufacturing building was exposed to occupational noise at an eight-hour time weighted average of 88.9 dBa, which exceeded the OSHA action limit of 85 dBa.
