29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): Excavation at 2360 Windy Hill Road: On or about May 3, 2016, and at times prior, the employer exposed employees to cave-in hazards as an employee was working in an excavation more than 5-feet, 4-inches deep, in that a cave-in protection system was not provided to the employee cutting metal corrugated pipe inside the excavation with a cut-off saw. Construction Management & Engineering Services (CMES, Inc.) was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1059174, citation number 2, item number 1,and was affirmed as a final order on 06/2/2015, with respect to a workplace located at 2691 Windy Hill Road SE, Marietta, GA 30067.
