Text For Citation: 01 Item/Group: 001 Hazard: LIFTING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Being caught-in/caught-between type crushing hazard a) Route 46 and Gold Mine Rd, Budd Lake, N.J. On 3/27/96 an employee was struck-by and caught between a 2 1/2 ton steel plate and the street surface. The plate which measured 8 ft. wide by 18 ft. long, was rigged in a manner that did not control the suspended load. The employer utilized a hook that was not equipped with a safety latch, or other positive attachment, to prevent inadvertent detachment. One feasible and acceptable method of abatement to control the load as required by the American National Standards Institute, B-30.9 -1990, section 9-1.9, paragraph (e), would be to hitch or rig the sling using a positive attachment to control the load. Violation occurred on or about 3/27/96 And/or in the alternative 29 CFR 1926.651(e): Employees were permitted underneath loads handled by lifting or digging equipment. An employee was permitted underneath the falling radius of a suspended 2 1/2 ton steel plate being handled by a caterpillar back-hoe. Employee was struck-by and caught between the steel plate and street surface when the load dislodged from the hook. Violation occurred on or about 3/27/96
