OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from struck-by hazards: At the workplace located at 440 J Street Lincoln, NE 68508 the employer is failing to protect employees from struck-by, caught between, and roll-over hazards associated with the operation of heavy equipment. On or about 14 April 2016 and at times prior the employer did not take necessary precautions to ensure that pedestrians, bystanders, and operators are protected from struck-by, caught between and roll-over hazards while employees operate the Case SV300 skid steer. Amongst other means, feasible means of abatement include but are not limited to the following: 1. Ensure operators are alert and always know the location of all workers in the area and keep all other persons completely away from the machine. 2. Ensure operators read and understand all the safety messages in the operators manual before operating or servicing the machine." 3. Per page 22 of the 2013 AEM Skid Steer Loader Safety Manual "Keep bystanders away, even if your machine is equipped with a back-up alarm." 4. Per page 23 of the 2013 AEM Skid Steer Loader Safety Manual "Never allow an untrained or unqualified person to operate the machine."
