Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the rotating structure of a John Deere 792D LC excavator: Location: I-684 entrance ramp connecting I-287 to I-684 On or about 11/7/96, a) A signal person was not used to signal the operator of a John Deere 792D LC excavator that all employees were clear before the operator rotated the cab of the excavator in congested areas. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To use a signal person when moving, swinging, or operating the excavator in congested areas as described in the John Deere 792D LC Excavator Operator's Manual (John Deere Dubuque Works OMT155285 Issue 15) on page 05-7 under the topic MOVE AND OPERATE THE MACHINE SAFELY.
