Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of getting shot with a nail fired out of a pneumatic nail gun: Location: Construction Site: Unit 19, Brookridge Court, Ryebrook, NY 10573. On or about 08/01/94 a) Employees using Hitachi Round Head Nailers, Model NR83A pneumatic nail guns were exposed to the hazard of being struck by nails fired out of the guns while the nail outlet is directed at a the operator or another employee. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECTS THIS HAZARD IS...." 1. Prohibit employees from operating pneumatic nail guns until they are properly in the safe use of it. (Not to point the nail outlet at themselves or other employees). 2. Follow the Hitachi Round Head Nailer Model NR83A recommendations for safe operating procedures contained in their Instruction Manual. Page 3, Paragraph 8, Page 4, Paragraph 13, Page 10, Paragraph 2 (Caution).
