Section 5(a)(1) of the Occupational Safety and Health Act of %% 1970: On or about 03/17/94 through 03/19/94, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the loading of a scaffold in excess of the design load nor used in accordance with the manufacturer's recommendations. As referenced in American National Standard for Construction and Demolition Operations - Scaffolding - Safety Requirement A 10.8 1988; Section 4. General Requirements for All Scaffolds, Rule 4.9: Scaffolds shall not be loaded in excess of the design load. Manufactured scaffolds shall be used in accordance with the manufacturer's recommendations. a)LOCATION: SOUTHEAST SIDE OF JOBSITE, ELEVATOR SHAFT, ON OR ABOUT 03/17/94 - THE TUBULAR WELDED FRAME SCAFFOLD WAS OVERLOADED BY MORE THAN A FACTOR OF 4TIMES THE MAXIMUM INTENDED LOAD. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ENSURE THAT EMPLOYER REPRESENTATIVES UNDERSTAND AND ADHERE TO DESIGN LOADS AND MANUFACTURER'S RECOMMENDATIONS.
