Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: In the following instances, seat belts were not worn by employees operating forklifts on even and uneven surfaces, over crane rails, and in vehicular traffic lanes. Seat belts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a rollover or collision: a)Yard - The operator of a Yale forklift #514. b)Yard - The operator of a Yale forklift #481. c)Blue Warehouse - The operator of a Hyster 650 forklift. d)Plate Yard - The operator of the Hyster 70 forklift #699. e)A Bay - The operator of a Hyster 40 forklift #649. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all forklift operators wear seatbelts.
