Text For Citation: 01 Item/Group: 001 Hazard:
Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: (a) On or about March 30, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating a Cincinnati 75 ton press brake where the foot control pedal was not covered to prevent inadvertent operation in the welding and fabrication room at 104 First Street Southwest, Cooperstown, North Dakota. (b) On or about March 30, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating a Steelweld press brake, Model No. H3 ½ -12, Serial No. M-2350 where the foot control pedal was not covered to prevent inadvertent operation in the welding and fabrication room at 104 First Street Southwest, Cooperstown, North Dakota. (c) On or about March 30, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating a Steelweld press brake, Model No. AI-4-16-22, Serial No. MO-9770 where the foot control pedal was not covered to prevent inadvertent operation in the fabrication room at 104 First Street Southwest, Cooperstown, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct the hazard is to provide a guard or cover for the foot control pedal that meets the requirement of the American National Standards Institute (ANSI) B11.3 2002 (R2007) Safety Requirements for Power Press Brakes, Section 6 Design, Construction, Reconstruction, and Modification and specifically 6.10.4 Foot Control, which states: When provided, foot controls shall be protected to prevent actuation from falling or moving objects, or from unintended actuation.
