Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a moving vehicle: (a) Location - Establishment: On or before 03/17/00, employees were exposed to the hazard of being struck while directing a trucks backing up. Among other methods, feasible and acceptable method to correct this hazard are the following: 1.Designation of an authorized and trained signalman to assist drivers while backing. 2.Ensure that truck operators and employees working in the area are trained on proper truck backing procedure. 3. Installation of a mechanical/electrical presence sensing device that would sound during truck backing. 4. Policy to ensure that no one is in back of the truck during backing up operations when drivers field of vision is blocked.
