Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving trucks while attempting to unjam a faulty load leveler or struck by moving fork trucks in the event that the levelers failed while they were in use. A) LOCATION: SHIPPING AND RECEIVING DOCKS EMPLOYEES REQUIRED TO USE DOCK LEVELERS THAT WERE NOT PROPERLY MAINTAINED WERE EXPOSED TO BEING STRUCK BY MOVING TRUCKS WHILE UNJAMMING THEM AND ALSO BEING STRUCK BY MOVING FORK TRUCKS IF THE LEVELERS WERE TO FAIL WHILE THEY WERE IN USE; ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS TO INSURE THAT THE LEVELERS ARE MAINTAINED ACCORDING TO MANUFACTURERS RECOMMENDATION AND REPLACE THEM WHEN THAT IS NO LONGER POSSIBLE. IN ADDITION, WHEN MAINTENANCE OPERATIONS ARE IN PLACE ON THE LEVELERS, A PROCEDURE SHALL BE IN PLACE TO INSURE THAT MOVING VEHICLES CAN NOT ENTER THE AREA IN WHICH WORK IS BEING DONE.
