Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling racks and falling product when racks that were damaged and racks with job-made repairs were used to store materials. This hazard was recognized by the employer who had performed job-made repairs on some of the racks. On or about March 17, 2016, employees were exposed to struck-by hazards while performing work around damaged racks. The racks were in use with materials stored in all locations of the racks. The materials stored weighed 250-300 pounds per stack. Forklifts are used to access the materials in the racks. a. Rack with twisted leg and bent brace at location 03-01-0 b. Rack with bent leg at location 05-01-0 c. Rack with bent leg, bent brace, and job-made repair at location 09-01-0 d. Rack with bent leg at end rack close to the wall at the very wide aisle in the warehouse area In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
