Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) At the load out area, employees were exposed to a potential fall hazard while working on top of covered hopper cars due to the lack of fall protection during grain loading operations. Among other methods, one method to correct this hazard would be to install some type of fall protection (body harness with lanyard, guardrails or an equivalent means of protection).
