Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) Employees of Industrial Contract Services, Inc., working on the construction site located at 4128 27th Avenue NW in Grand Forks, North Dakota, on or about November 16, 1995, were exposed to the hazards associated with fire/explosion while working with a liquid petroleum gas (propane) container with blow torch attached, that did not have adequate guarding to protect appurtenances against physical damage. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all portable liquid petroleum gas containers in use that utilize gas flow regulators are provided with adequate guarding in accordance with National Fire Code #58, 2-2.4, Portable Container Appurtenance Physical Damage Protection.e
