Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended actuation of a foot pedal not protected by a guard: (a)Shop - No means were provided to protect the three (3) foot pedals of the Niagara power shear from unintentional actuation by falling or moving objects or by someone accidently stepping on it, on or about November 5, 2002. (b)Shop - No means was provided to protect the foot pedal of the Cyril Bath mechanical press brake from unintentional actuation by falling or moving objects or by someone accidently stepping on it, on or about November 5, 2002.
