Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from and/or with an elevated work platform that was not adequately secured to the lifting carriage and/or forks of a powered industrial truck: (a)Row 41 In Warehouse Distribution Facility - An employee, who was performing work activities, fell approximately twenty-five (25) feet when the work platform was pulled off the forks because it was not adequately secured to the lift truck, on or about November 20, 2002. Among other methods, one feasible and acceptable method to correct this hazard is to provide and adequately secure work platform(s) to lifting carriage(s) and/or forks, in accordance with ANSI/ASME B56.1 (2000), Section 4.17.3(b), or utilize equipment such as scissors lifts.
