Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: THE UNPROTECTED SWING RADIUS OF OPERATING MOBILE EXCAVATORS WORKING THOROUGH THE JOBSITE. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO INSTRUCT THE WORKERS ON THE JOBSITE ON A DAILY BASIS OF THE HAZARDS INVOLVED IN ROTATING SUPERSTRUCTURES ON THE EXCAVATORS, TO MAINTAIN A SAFE DISTANCE FROM THEM AT ALL TIMES, AND TO POST WARNING/DANGER DECALS ON THE THREE SIDES OF THE COUNTERWEIGHT.
