OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees and exposed them to crushed by hazards. The employer did not ensure an employee was in use of a seat belt while operating a powered industrial truck. On or about February 23, 2016 and at times prior there to, an employee was not using the required seat belt while operating a powered industrial truck, exposing the employee to a crushed-by hazard.
