Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a food mixing auger: Meat Room - A portable rolling ladder locking devices did not work and the top rail of the rolling ladder was only 29 inches high, which could result in employees falling to the floor or into the mixing auger. The feasible means of abatement is to repair the locking device and provide a higher top rail or provide fall protection.
