OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while loading appliances into customers' vehicles in an unprotected area: a) An employee was assisting a customer load a washer into his SUV on January 6, 2016. The customer was backing his vehicle, while the employee was directing the vehicle towards the curb in front of the store to load the washing machine. The customer's foot slipped off of the brake pedal and onto the gas pedal, causing the vehicle to go over the curb and strike the employee.
