OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to unsecured loads: On or about January 22, 2016, at the above located workplace, employees were unloading Fiber -Tech Altek unsaturated polyester resin U-Haul composite walls weighing approximately 400 pounds from a tractor trailer when one of the panels became hung up on the trailer floor boards. An employee inside the trailer waiting for a fork lift to assist in the moving of the panel was pinned when the unsecured panels fell between the panel and side board of the trailer. On January 22, 2016, among other methods, one feasible and acceptable means to correct the hazard was to follow best practices and procedures to safely unload Fiber-Tech Altek unsaturated polyester resin U-Haul composite walls, and other similar oversized freight from tractor trailers and train all employees on such unloading practices and procedures.
