OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rollover hazards created by the operation of an excavator on a steep slope in hazardous weather conditions: a) Property of 237 Mooresburg Rd., Liberty Twp., PA: On or about January 6, 2016, A Yanmar excavator (Model Vi035-2/SN 22480B) being operated on a steep slope with an icy and frozen ground surface rolled over while the operator was attempting to remove soil from the top of the slope, exposing the employee to fatal crushing injuries.
