Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to caught-in-between and crushing hazard while operating equipment: Worksite: On or about December 16, 2015, the employer failed to ensure that an employee, who was operating a hydraulic excavator with a missing window, was free from caught-in-between and crushing hazards by maintaining the manufacturers original protective barriers. An employee reached through the missing window opening and sustained fatal crushing injuries after being caught between the body of an excavator and the arm of the excavator.
