OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushing hazards from inadequate guarding during the use of stand-up forklifts. (a)At the plant, an employee was exposed to horizontal intrusion and under-ride hazards while operating standup power industrial trucks in a forks trailing manner without proper guards. The employee was operating a Caterpillar NR4000 Rider Reach Electric forklift when he collided against a lower horizontal crossbar member of a storage-rack shelving system sustained a fatal injury, on or about 12/11/2015.
