OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. a. Facility: Daily Pre-Trip Forklift Checklist noted that the TCM E 820 Loader had mechanical defects, such as but not limited to hydraulic-fluid leaks, non-working horn, free play steering, service and parking brakes resists when applied on 12/01/15, 12/02/15 and 12/03/15 was not removed from service, on or about 12/04/2015. Park Stein, Inc dba Parkway Iron and Metal Company Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 314681529, citation number 1, item number 1 and was affirmed as a final order on 10/19/2012, with respect to a workplace located at 613-614 Route 46 East, Clifton NJ, 07015.
