29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents a) The employer does not ensure that employees use eye protection while using pneumatic nail guns during the course of residential construction activities, thus exposing employees to severe eye injuries. This violation was most recently observed at the property 1427 Kater St., Philadelphia, PA 19146 on October 27, 2015, where employees were engaged in constructing a new residential home without the use of eye protection. To abate this ongoing violation, the employer must provide and require the use of eye protection during construction activities.
