OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees who ride the carriage of the Hi Cube storage system and enter the racking system are not protected from inadvertent movement by the operator below. a) Whirlpool Findlay, OH: On or about December 13, 2011, the employer did not assure employees who ride the stacker carriage to retrieve parts from the Hi Cube storage system were protected from inadvertent movement by the operator below by means of emergency stop. Employees climb out and back in from the racking system to retrieve parts without having any control over the starting/stopping of the carriage.
