Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about February 15, 1991, at 7393 NW 36 Street, Miami, FL, employees were exposed to the hazard of being struck by or run over by a Caterpillar Model 416 Backhoe Loader, SN 5PC06454, the operator was not trained or instructed in the safe operating procedures to follow when performing backhoe operation. The Caterpillar Operation Manual specifies for starting engine or using the backhoe: "Engage the parking brake, put transmission in neutral and engage the foward-reverse lock." Among other methods one feasible and acceptable abatement method to correct this hazard is to follow the Caterpillar Model 416 Operations Manual for the Backhoe Loader.
