Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a vehicle accident: a.A Ford Dumpster truck #276, equipment number 850-040-00276, used to haul dumpsters did not have a functional windshield wiper, and had no rearview mirror. b.A Caterpillar #966, equipment number 411-040-0267 Serial Number 76J13567, had no rearview or sideview mirrors, no functional windshield wipers and an unstable steering column. Vehicular accidents can occur because drivers may not be able to safely operate the vehicles. Among other methods, one feasible and acceptable abatement method to correct these hazards is to ensure that the vehicles are properly and regularly maintained, and any vehicle not in safe operating condition is to be removed from service until repairs are made by authorized personnel.
