Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling materials due to unplanned collaspe in that: (a) Employees were not prevented from piling gravel in one location on the roof, therby placing a superimposed load on the building roof joists causing a structural failure. Among other methods one feasible and useful method to correct this hazard is to remove the gravel from the roof area, rather than pile the gravel in one location, creating a superimposed load on the roofing joists.
