Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were permitted to operate a John Deere 544C loader without the use of a seatbelt: (a) Sawmill: On or about October 21, 2015, and times prior, employees were permitted to operate the loader, equipped with forklift attachments, without the use of the seatbelt that was installed by the manufacturer, exposing them to crushing injuries associated with rollover hazards.
