Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment to which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about August 25, 1992, at American Trail Development an employee operating a Caterpillar dump truck #769-B -S/N 780-99F4341, went backward over the edge of a quarry, where the ground dropped off and there was no restraint at the edge; exposed the employee to the hazard of drowning. Among other methods one feasible and accfeptable method to correct this hazard is to: (1) Provide berms, bumper blocks or similar means to prevent overtravel or over-turning at the dumping location. (2) Where it appears that the ground may fail in the dumping area due to changing density of the ground and/or weight of the vehicle loads should be dumped well-back fromt he edge of the quarry.
