Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On 2/16/94 - Job site, in front of 133-22 Inwood Street Employee was exposed to the hazard of falling out of the bucket of a Dynahoe model 490K power shovel while standing in the bucket as the bucket was being raised and lowered into and out of the excavation. (b)On 2/17/94 - Job site, in front of 133-22 Inwood Street Employee entered / exited excavation measuring 12 ft. 11 inches long X 6 ft. 2 inches wide X various depths from 10 ft. 3 inches to 11 ft. by standing inside of a Dynahoe model 490K "backhoe bucket". Among other methods one feasible and acceptable abatement method to correct this hazard is to: (1)Develop and implement a training program specifically addressing safe operating procedures while using a backhoe and, (2)Enforce safety and health rules established by the
