OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to injuries from utilizing damaged racking systems: (a) Throughout the facility; Pallet rack systems with unanchored, out-of-plumb, and out-of-straight columns were used to store items such as but not limited to wood, boxes for shipment and various other parts and supplies.
