Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an unstable mobile steel frame being used to lift material from a trailer: Among other methods, one feasible and acceptable abatement method is to provide a lifting frame designed for the purpose for which it is intended to be used. At The Worksite - A steel frame designed to support an ice machine in a fixed location was modified and used as a mobile lifting device. Those modifications failed to provide adequate support to prevent unintentional trippage and displacement.
