Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that may result in broken bones and/or serious injuries to employees operating a powered industrial truck while not wearing seatbelts: At the worksite, Production Area - In the following instances the employer did not insure that employees were wearing seatbelts during forklift operations: a.On 3/1/99 CSHO observed employees operating a powered industrial truck while not wearing seatbelts. b.On 3/4/99 CSHO observed employees operating a powered industrial truck while not wearing seatbelts c.On 3/10/99 CSHO observed employees operating a powered industrial truck while not wearing seatbelts. A couple of feasible means of abatements, among others, would be to enforce a disciplinary policy or install a switch on the seatbelt that would prevent the forklift from starting unless the operator was wearing a seatbelt.
