Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by truck(s) operating in reverse gear: a) On or about 10/1/93, a refuse truck was operating in reverse gear, while an employee was working at the rear of the w=vehicle, and was obscured from view. Among other methods of abatement is to provide for instruction and training in safe methods of work to all employees before assigning them to work, as well as monitoring the employee's adherence to safe practices such as stipulated by ANSI Z245.1 "American National Standard for Refuse Collecting and Compacting Equipment - Safety Requirements". An essential element of the training program would include having the outside person in clear view of the truck driver in all backing operations.
