Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on and before 8/9/91 employees were exposed to the hazard of falling from and/or being struck by railroad cars when attempting to mount the railroad cars while the cars were in motion. Employees were required to mount moving rail cars in order to operate hand brakes during rail car spotting operations. Among other methods, one feasible and acceptable method to correct these hazards is to establish and implement a program of instruction and training in railroad operating rules meeting the requirements of the Federal Railroad Administration Regulation 49 CFR 217.11(a) and (b). Specific elements of the abatement program shall be expected to include, but not necessarily be limited to: 1. Training all employees in recognition and avoidance of hazards associated with rail car spotting operations. 2. Ensure that spotting and switching operations be performed by a minimum of 2 employees consisting of brakeman and loader operator. 3. Visual and/or radio contact shall be maintained at all times during rail car movement. 4. Railroad cars shall not be moved or otherwise set into motion if the brakeman is not in proper position on the car to be moved. Getting on or off of moving rail cars or other equipment shall be prohibited. 5. The tracks will be surveyed to ensure proper clearance for fixed or temporary obstructions before movement of cars. 6. Spotting shall never be done at speeds in excess of 6 mph. 7. Special instruction signs shall be posted to warn employees of reduced clearance between rail cars and fixed or temporary objects.
