Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Truck loading rack no. 9: On or about 12/13/93, employees, standing on the top of a tank truck were exposed to the hazard of being struck by the sudden uncontrolled movement of the loading pipe during an air purging operation. Among other methods, one feasible and acceptable abatement method would be to install bleed valves at the discharge end of the moveable loading arms to allow for a controlled gradual release of pressure within the piping system, as well as installation of a "T" type fitting at the end of the loading pipe. These modifications should also be supplemented with training of all employees who might be involved in purging air from the piping system, and the development of a step by step written procedure, so as to ensure that proper procedures are followed during purging operations.
