Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of operating heavy equipment without first receiving equipment specific training, indoctrination, and warnings as supplied by equipment manufacturer(s): On or about September 16, 1994, an operator of a Ford L 8000 Dump Truck, company vehicle number 178051, took a position outside of the truck cab, and between the cab and the descending dump body, without having received prior training, indoctrination, and being made aware of the warnings to remain at the vehicle controls, in the cab, during dumping operations. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train operators in the safe operations of dump vehicles using the literature as provided by the manufacturer, which includes direction that the operator remain in the cab during dumping operations, and to post and maintain, on the vehicle, the warning decals provided by the manufacturer which contain, among other warnings, the Caution message, " Operator Must Remain at Controls In Cab During Dumping Operations".
