Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or striking a stationary object or another vehicle: a) On the property, crossing Bob Head Road, and on the north farm employees use golf cars to access other parts of the property and carry supplies; tow equipment such as but limited to trash bins and boxed fish for shipment. the golf cars do not have brakes and backup warning devices on the cars are not operational which expose employees to crushing injuries resulting from not being able to stop the vehicle in emergency situations, on or about 10/17/94. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the brakes and backup devices repaired and establish a preventative maintenance schedule and program.
