29 CFR 1904.7(b)(3): Recording a work-related injury or illness that results in days away from work. When an injury or illness involved one or more days away from work occurred, the employer did not record the injury or illness on the OSHA 300 Log with a check mark in the space for cases involving days away and an entry of the number of calendar days away from work in the number of days column. For cases where the employee was out for an extended period of time, the employer did not update the day count when the actual number of days was known: (a) Throughout the facility. On or about October 1, 2015 through January 22, 2016, the employer did not correctly classify the following workplace injuries or illnesses as cases involving days away from work on the OSHA Form 300 or its equivalent for the calendar year 2015: (1) AFE Pack: On 7/29/15 an employee developed low back pain that resulted in restriction or job transfer and approximately 165 days away from work that continued into January 2016. Log case number 35 was recorded as 0 days away from work. (2) Pack Singles: On 10/2/15 an employee developed neck and shoulder pain picking products resulting in restriction or job transfer and the injury involved days away from work that continued into November 2015. Log case number 157 was recorded as 0 days away from work. (3) ICQA: On 10/27/15 an employee developed shoulder pain after reaching into the bottom row of the pod resulting in restriction or job transfer and the injury involved days away from work that continued into January 2016. Log case number 206 was recorded as 87 days away from work and 0 days of restriction or job transfer. (4) Ship: On 10/12/15 an employee dropped a box on their right foot resulting in a fracture to the metatarsal bone with 116 total days of restriction or job transfer and the injury involved days away from work. Log case number 169 was recorded as 49 days away from work and 49 days of restriction or job transfer. (5) AFE: On 10/3/15 an employee developed pain to their knees bending for product resulting in 122 days away from work. Log case number 216 was recorded as 78 days away from work. (6) AFE: On 10/26/15 an employee developed back pain from lifting product resulting in approximately 30 days restriction or job transfer and the injury involved days away from work of at least 4 days.
