OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. Employer failed to keep the workplace free of a recognized hazard by not ensuring that band saw operators in the meat dept. properly used the band saws adjustable guard as prescribed in the operation manual for the band saw: "before turning saw on, raise or lower the upper guide and guard assembly....so the cutting zone is only as high as necessary for the piece being cut"
