Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: A) Bell Realty, Inc., Bell Mt. Development Site - A warning system (observer/spotter, stop logs, barricade) to alert the drivers that they were approaching the edge of the soft earthen dump, was not being utilized at the Northwest Waste Area Dump Site, September 24, 1990. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO HAVE AN OBSERVER/SPOTTER AT THE TOP OF THE DUMP SITE TO GUIDE DRIVERS TO A SAFE DISTANCE FROM THE EDGE TO UNLOAD, THEN UTILIZE GRADER OR EQUIVALENT EARTH MOVING EQUIPMENT TO LEVEL/PUSH DUMPED EARTH TO EDGE AND/OR UTILIZE BARRIERS STOP LOGS (OR EQUIVALENT) TO ALERT/STOP DRIVERS THAT THEY ARE APPROACHING DANGER ZONE/EDGE. METHODS IMPLEMENTED MUST BE SUPERVISED CLOSELY AND THE DRIVERS INSTRUCTED/TRAINED ON A SAFE DISTANCE APPROACH/WARNING.
