Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: (a)CBT Lumber and Hardware Inc., mechanic shop: The mechanic was exposed to a crushing hazard when he was working under a dump truck with the bed of the truck left in an inclined position without any positive support capable of locked in position in the event the hydraulic fails or the bed accidently lower to its resting position.
